Hon. Patrick H. NeMoyer is a justice of the Supreme Court of the State of New York, Appellate Division, Fourth Judicial Department. He was appointed to the Appellate Division by Governor Andrew Cuomo in 2016.
At the time of his appointment, NeMoyer was serving as a justice of the Erie County Supreme Court. He was elected to the Supreme Court in 1998 and was retained to the seat in subsequent elections.
NeMoyer received a B.S. in business administration from the State University of New York at Binghamton in 1974. He also earned a J.D. from the State University of New York at Buffalo School of Law in 1977. In 1981, he then completed an M.A. in economics at the State University of New York at Buffalo.
He began his legal career as a confidential law clerk and principal law clerk to the Hon. James B. Kane, administrative judge of the Eighth Judicial District. After his clerkship, NeMoyer became the county attorney for the Erie County Department of Law, a position he held from 1988 until 1993. It was at that time, he was nominated to serve as U.S. Attorney for the U.S. Attorney’s Office for the Western District of New York by former President Bill Clinton. NeMoyer remained in that capacity until assuming the Supreme Court bench.
He served as a member of the New York State Pattern Civil Jury Instructions Committee and served on the Board of Directors for the Center for Handicapped Children.
He was named Judge of the Year by the New York State Trial Lawyers Association - Western District in 2006 and by the Erie County Bar Association’s Commercial and Bankruptcy Committee in 2001. NeMoyer was also named Jurist of the Year by the Erie County Bar Association’s Matrimonial and Family Law Committee in 2000.
He and his wife have four daughters.
