BEFORE ME, the undersigned authority, personally appeared Steve C. Davis, ESQUIRE, who, first being
duly sworn, on oath, deposes and says:
1. That I am an associate at Lotane & Associates, P.A., the attorneys of record for the Plaintiff(s), am over
the age of eighteen, and that this Affidavit is made on personal knowledge.
2. That a Stipulation\Settlement Agreement was entered into between the parties whereby the Defendant,
Richard Smith was to make payments to the Plaintiff(s) on a periodic basis. The original of the
Stipulation\Settlement Agreement appears in the Court file, and a copy which is attached hereto.
3. That the parties entered into a Settlement Agreement, wherein the Defendant, agreed to pay $101,726.44,
with a default clause for $101,726.44 by paying monthly payments of $600.00 starting on May 01, 2020. To this
date the Defendant has paid $2,449.00, and now has failed to make the payments due under the terms of the
Stipulation\Settlement Agreement since August 5, 2020, with the result that there is at the present time due and .
owing to the Plaintiff(s), the principal sum of $101,242.09, interest in the sum of $0.00 and Court Costs in the i
sum of $484.35, less payments made in the amount of $2,449.00, making a total sum of $99,277.44.
