DEFENDANT’S MOTION FOR MEDIATION
Defendants, ANTHONY SMITH and GWENDOLYN SMITH, pursuant to Rule 2.545 of
the Rules of Judicial Administration and Rule 1.700 of the Florida Rules of Civil Procedure,
hereby moves the Court to enter an Order compelling the parties to Mediate this matter within 45
days of the answer or paper served or filed by the Defendant making such a request and in
support, states as follows:
1 Defendants, as borrowers on the alleged mortgage sued upon in this case, hereby
requests that this case be referred to mediation. Undersigned states, under penalty of perjury,
that upon information and belief, Defendants are currently living in the subject property, as their
primary residence and the property has a homestead tax exemption.
2 The Judge may enter an order referring the parties to mediate pursuant to Rule
1.700(a), FL R. Civ. P.
NOW, THEREFORE, the Defendants believe that Mediation may help the parties resolve
the issues set forth in Plaintiff's Complaint and asks the Court to enter an Order requiring the
