Wherefore, the GENERAL MAGISTRATE submits this Repo: rt to the undersigned Circuit Judge. THIS CAUSE came before the Court on Defendant’s Motion for Mediation and Motion for Enlargement of Time to Respond to Complaint. Counsel for the Petitioner was present for the hearing, by telephone. The Defendant was present for the hearing, pro se. The Court received evidence and testimony and observed the demeanor and evaluated the credibility of each witness. It relied on these observations and evaluations in determining the facts recited below. Based upon the testimony, the pleadings and evidence received, the Court finds the following: The court has jurisdiction over the parties and the subject matter. Based on the above findings the General Magistrate recommends as follows: A Defendant’s Motion for Mediation is GRANTED. The mediation shall occur within 60 days of the entry date of the Order on General Magistrate’s Report and Recommendation. Plaintiff's Representative may appear by phone. Defendant’s Motion for Enlargement of Time to Respond to Complaint is GRANTED. The Defendant shall file a response to Plaintiff's Complaint with 30 days of the entry date of the Order on General Magistrate’s Report and Recommendation. Cc.
